Riverhead Brewing Company Customer Loyalty Program Rules & Regulations Effective Date: August 30, 2026 These Rules & Regulations (“Terms”) govern participation in the Riverhead Brewing Company Customer Loyalty Program (the “Program”), operated by Riverhead Brewing Company (“Riverhead,” “we,” “us,” or “our”). By enrolling in or participating in the Program, you agree to these Terms, as amended from time to time in accordance with applicable law. 1. Eligibility: The Program is available to eligible customers who meet the requirements established by Riverhead Brewing Company. Riverhead reserves the right to refuse, suspend, or terminate participation in the Program where permitted by law, including in cases of suspected fraud, abuse, misuse, or violation of these Terms. Participation in the Program is voluntary and does not require the purchase of any particular product or service beyond the purchases necessary to earn points. 2. Earning Points: Members earn ten (10) loyalty points for every one dollar ($1.00) spent on qualifying purchases at Riverhead Brewing Company, unless otherwise specified by Riverhead. Points are awarded based on the eligible purchase amount before applicable taxes, unless Riverhead specifies otherwise. Points cannot be earned on purchases that are excluded from the Program or on transactions that Riverhead determines are ineligible. Riverhead may establish, change, or discontinue particular methods of earning points, provided that any such changes comply with applicable law. 3. Points Have No Monetary Value: Loyalty points are promotional rewards and have no cash or monetary value. Points are not currency, are not legal tender, are not refundable or redeemable for cash, and cannot be sold, transferred, assigned, or exchanged for cash except where required by applicable law. Points do not constitute a deposit, gift card, prepaid card, or monetary account. 4. Redeeming Points: Points may only be redeemed for rewards, discounts, products, services, or other benefits specifically designated by Riverhead. Riverhead may establish minimum redemption requirements, eligible rewards, redemption limits, and other reasonable conditions applicable to the use of points. 5. No Transfer or Sale of Points: Points are personal to the Program member and may not be sold, bartered, transferred, assigned, or combined with another member’s points unless Riverhead expressly permits otherwise. Riverhead may cancel points obtained through fraud, abuse, unauthorized transactions, or other activity contrary to these Terms, subject to applicable law. 6. Changes to the Program: Riverhead Brewing Company reserves the right to modify, suspend, or terminate the Program, or any portion of the Program, at any time, subject to applicable law. Riverhead may change the rate at which points are earned, the rewards available, redemption requirements, eligibility requirements, or other Program terms.If the Program is terminated or points are cancelled, suspended, or otherwise affected, Riverhead will do so in accordance with the requirements of applicable Ontario law. Nothing in these Terms is intended to waive, limit, or exclude any rights or protections that a customer may have under applicable law. 7. Program Termination: Riverhead Brewing Company reserves the right to cancel or terminate the Program at any time, with or without notice, where permitted by applicable law. Upon termination of the Program, customers' accumulated points will be treated in accordance with these Terms and all applicable laws and regulations. Riverhead will not be required to honour, replace, reimburse, or otherwise compensate customers for points that are lawfully cancelled or rendered unusable following termination of the Program. 8. Account Termination and Fraud: Riverhead may suspend or terminate a member's Program account where permitted by law if Riverhead reasonably believes that the member has: violated these Terms; engaged in fraudulent or deceptive activity; attempted to manipulate or abuse the Program; used the Program in an unauthorized manner; or engaged in conduct that may negatively affect the integrity or operation of the Program. Any cancellation, suspension, or forfeiture of points will be subject to applicable law. 9. Points Records: Members are responsible for reviewing their points balance and reporting any apparent errors to Riverhead within a reasonable period. Riverhead reserves the right to correct a member's points balance where an administrative, technical, transaction, or accounting error has occurred. 10. No Guarantee of Availability: Riverhead does not guarantee that the Program, points, rewards, or any particular reward will remain available for any specific period of time. Rewards may be subject to availability, applicable restrictions, and other conditions established by Riverhead. 11. Changes to These Terms: Riverhead Brewing Company may amend these Rules & Regulations from time to time. Updated Terms may be communicated through the Program, Riverhead's website, in-store notices, or other reasonable means. Continued participation in the Program following any permitted amendment constitutes acceptance of the updated Terms. 12. Compliance With Applicable Law: The Program is governed by the laws applicable in the Province of Ontario and Canada. Nothing in these Terms is intended to exclude or restrict any consumer right, remedy, or protection that cannot legally be excluded or restricted. If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to comply with applicable law, and the remaining provisions will continue in effect. 13.
